Waiver and Cancellation Policy

MEDICAL CONDITIONS AND SPECIAL REQUIREMENTS

The Client must notify the Company in writing during the process of booking of any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect fitness to travel and or any medical condition. Failure to notify the Company may result in the Client being refused travel. Failure to notify the Company of any such condition that results in cancellation will have full cancellation fees applied to the Client. Some trips may be unsuitable for Clients due to age, mobility, disability, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to booking. The Company may refuse to carry pregnant women over 24 weeks or Clients with certain conditions. The Company is not required to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not liable for not providing these requests. Medical facilities vary from country to country and the Company makes no representations and gives no warranties in relation to the standard of such treatment.

DEPOSITS

A 25% deposit is needed upon booking to confirm your spot. For tour inside of Egypt, If booking is made 15 days or less prior to departure, full payment is due. For tours outside of Egypt, If booking is made 4 weeks or less prior to departure, full payment is due. Tailor Made tours may require a higher deposit or full payment at the time of booking. If deposit is different from that outlined in this clause, the requirement will be advised at time of booking and detailed on the invoice. If combinations of Tours, Independent Tours and Tailor Made tours are booked, the most restrictive requirements will apply to the whole booking.

 

CANCELLATION OF A TOUR BY THE CLIENT

The date on which the request to cancel is received by the Company or its Agents will determine the cancellation fees applicable. There are two options to managing the deposited amount in the case of cancellation, which the client will have the option of choosing.

P.S Any cancellation due to reasons other than a cancellation of the tour by Gazef due to reasons mentioned in the next clause including Visa rejection, Flight cancellation, Personal reasons and other reasons out of the company's control will follow the below rules. 

Option 1: The cancellation fees are expressed hereafter as a percentage of the total tour price. The amount returned is in cash

Option 2: At the client’s request, we may allocate a percentage of the deposited amount into a future trip’s credit (ie: a percentage of the amount that the client has deposited may be transferred into the credit of a future trip at the client’s request)

Option 3: In the case of COVID19 positive test the client needs to provide an official PCR test from a credible lab. In that case the client can either benefit from our special option 3 for future trip credit or the normal option 1 refund.

The Company reserves the right to cancel any trip for any reason, but will not cancel a tour less than 10 days before departure except for not reaching the minimum number of clients required per each trip, Force Majeure, unusual or unforeseen circumstances outside the Company’s control. When a tour is cancelled by the Company before the agreed date of departure for any reason other than the fault of the Client; the Client can either:

a. Take a substitute tour of equivalent or superior quality if the Company is able to offer such a substitute;

or b. Take a substitute tour of lower quality if the Company is able to offer one and to recover from the Company the difference in price between the price of the tour originally purchased and that of the substitute tour; 

c. Full cash refund and the company will notify the client at the time of cancellation with the refund process time line which should not exceed 24 days.

The Company is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, nonrefundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.

If the Client requests an alternative tour of a higher value than that originally booked, then the Client must pay the difference in price. Whereas after departure a significant element of the trip contracted for cannot be provided, the Company will make suitable alternative arrangements for the continuation of the trip. If it is not possible to provide a suitable alternative or the Client reasonably rejects any suitable alternatives, the Company will provide the Client a refund of unused tour portions. Where a significant alteration or cancellation occurs which is not due to Force Majeure or other circumstances beyond the Company’s control, the Company will in some circumstances offer compensation. Significant alterations do not include the substitution of a vessel, modification of itineraries, change in cabin category or hotel accommodation provided it is of the same category.

MEDIA RELEASE CLAUSE 

By participating in this trip, I understand and agree that Gazef reserves the right to capture photos, videos, and other content during the experience for promotional, commercial, or other purposes. I consent to the use of my likeness in such content across Gazef's platforms, including but not limited to social media, websites, and marketing materials.
Opt-Out Option: If I prefer not to have my images or videos used, I acknowledge that it is my responsibility to inform Gazef in writing or directly notify the trip leader prior to or during the trip.

Acknowledgment and Assumption of Risks, Release of Liability and Indemnity Agreement:

"GAZEF" is a travel agent that organizes adventure tours to countries in all seven continents around the world. In consideration for "GAZEF" permitting me to voluntarily participate in the tour, I (and in the event that the participant is a minor, the parents or guardians) agree to the following terms of this Agreement. I understand that international and back country travel includes certain inherent and other risks and dangers, all of which are too numerous to list, which include, but are not limited to, acts of Nature, terrorism, civil unrest, hazards of travel in difficult terrain, weather (including mudslides, rockslides, hurricanes, monsoons), altitudes, travel by air, motor vehicles, animal, or other conveyance, exposure to disease, drowning, accidents, bites.

 I further acknowledge that the forces of nature, crime, civil unrest and personal injury or illness in remote areas without means of rapid evacuation or adequate medical care or supplies are risks which exist in adventure travel. These risks cannot be eliminated and I willingly assume these risks. I understand that any of these risks may result in bodily or emotional injury, death and/or damage to property, including lost luggage or other belongings, to myself or to third parties.

I understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, or else I am willing to assume all risks that may be created, directly or indirectly, by any such condition. I hereby authorize "GAZEF" and the Tour Companies to arrange for any emergency medical treatment and hospitalization as may be necessary for me because of participation in this activity without my further consent.

I have been strongly advised to obtain travel insurance which, under certain circumstances, insures against unforeseen travel issues and risks such as inability to participate in the tour, travel/tourism bankruptcies, cancellations, interruptions, delays, lost/stolen/damaged travel documents and personal property, medical expenses, evacuation and other emergency transportation.

I have been advised of the "GAZEF" Cancellation Policy. As an independent travel agent, "GAZEF" will refer participants to travel industry suppliers, outfitters and guides who are not employees or agents of "GAZEF", including but not limited to suppliers of accommodations, meals, transportation (ground, water and air), recreational and leisure activities and entertainment and tours (collectively the (Tour Companies") or utilize Tour Companies for certain activities. Understanding the risks described in this document, I agree for myself, all of my family, including my spouse, minor children, and heirs and representatives to release "GAZEF", its related entities, owners, shareholders, directors, officers, members, managers, employees, guides, volunteers, agents, subcontractors, Tour Companies (as defined below), all other participants in the tour, and all other persons or entities acting in any capacity on 'GAZEF's behalf from any and all claims, demands for loss, damages (including without limitation damages related to the inherent risks and other dangers discussed above), injuries (including without limitation sickness, bodily or emotional injury or death), damage to property (including without limitation lost luggage or other belongings) or any other causes of action relating in any way to my participation in the tour. If I, or anyone on my behalf, files a lawsuit or otherwise makes a claim against "GAZEF", I agree to indemnify "GAZEF" and pay all damages, costs, fees, expenses and attorneys fees incurred by "GAZEF" in defending such a lawsuit or such claims. In no event will 'GAZEF's liability to a traveler be greater than the amount of the fees paid by the traveler to "GAZEF" for the tour, even if the amount of damages suffered by the traveler may be greater than this amount. Furthermore, in no event will "GAZEF" be liable for any indirect, special, incidental, consequential or other damages, however caused, whether for breach of contract or otherwise, and whether or not advised of the possibility of such damages occurring. I agree that the interpretation of this document or of any other aspect of my relationship with "GAZEF" shall be governed by the law of Egypt. If any provision of this document is found to be invalid or unenforceable, the remaining provisions of this document shall be enforceable to the maximum extent permitted by law. I hereby waive the right to trial by jury.

With respect to any minor child listed below, I warrant that I am the parent or guardian of such child and that I have the authority to make decisions as to my child's participation in recreational activities such as this tour.1 HEREBY CONSENT TO MY CHILD PARTICIPATING IN THE TOUR, AND 1 UNDERSTAND AND AGREE THAT ALL OF THE TERMS OF THIS AGREEMENT SHALL APPLY EQUALLY TO BOTH MYSELF AND MY CHILD.

This is the entire agreement of "GAZEF" and myself regarding liability for the tour, which supersedes all prior statements, representations or warranties, oral or written, express or implied.
